By accessing the site, applying to the publisher program, or embedding a Power-Up, you agree to these Terms. The specific commercial terms of the publisher program are set out in the Publisher Agreement, which is incorporated by reference.
Portune provides embeddable "Power-Ups" (Product Selection Guides and RFQ Builders) that help a publisher's readers make purchasing decisions and, in doing so, generate technically qualified leads (TQLs) that Portune matches and sells to advertisers. Features may change over time.
You must be a business, at least the age of majority, and able to form a binding contract. You are responsible for the accuracy of your account information and for all activity under your account and Publisher ID. Keep your credentials secure.
Portune and its licensors own the service, the Power-Ups, and all related IP. We grant you a limited, non-exclusive, revocable license to embed the Power-Ups per these Terms and the Publisher Agreement. You retain ownership of your website and content.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific earnings, lead volume, or conversion rate.
To the maximum extent permitted by law, Portune will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. Our aggregate liability arising out of or relating to the service will not exceed [the amounts paid or payable to you in the 3 months before the claim / a stated cap].
You will indemnify and hold Portune harmless from claims arising out of your use of the service, your website, your content, or your breach of these Terms or applicable law.
Either party may terminate as described in the Publisher Agreement. We may suspend or terminate access for violation of these Terms. Provisions that by their nature should survive will survive.
